الملخـــص:

يتناول هذا البحث موضوع دراسة الفروق في أصول الفقه دراسةً نظريةً تأصيليةً. وقد تناول:تعريف الفروق في أصول الفقه, وأوجه الفروق فيها, وموضوعها, وحكم تعلمها, ومصادر استمدادها, وأهمية وفوائد معرفتها, ولمحة موجزة عن نشأتها والمؤلفات التي انفردت فيها, وقد خَلُصَ البحث إلى مجموعة من النتائج أبرزها: أن معرفة الفروق توضح المقصود بالمصطلحات، وبالقواعد، وبالمسائل، وبالمناهج الأصولية التي يظهر بينها اتفاق في صفة أو أكثر، الأمر الذي يؤدي إلى الفهم العميق والدقيق لأصول الفقه، بحيث لا يمكن تكوين المَلَكَة الفقهية عند العالم والمتعلم إلا بمعرفته معرفة تامة.

Abstract :

This paper deals with a theoretical study of the differences between principles of jurisprudence. The paper addresses: definition, aspects of, differences, the subject and the ruling of learning the differences in the principles of jurisprudence as well as sources through which these differences are derived. Also, it addresses the importance and benefits of being aware of the principles of jurisprudence.  Furthermore, the paper provides a brief overview of the origin and literature on the differences in the principles of jurisprudence. The paper is concluded with a group of results the most significant of which is being aware that the knowledge of the differences illustrates the meaning of fundamental terms, rules, issues and approaches. These have one or more attribute in common, that leads to a deep and precise understanding of the principles of jurisprudence without which scholars nor learners can gain the know-how and experience.
