Hebron University Law Professor Publishes a Chapter in “International Handbook of Juvenile Justice”

Dr. Mutaz Qafisheh, Dean of the Hebron University College of Law and Political Science and Associate Professor of International Law, wrote Chapter 23 as part of the “International Handbook of Juvenile Justice” (Springer, Cham, Switzerland, 2017).The Chapter (pages 497-525) analyzed the 2016 Palestinian Juvenile Protection Decree-Law the official bodies that in charge of issues relating to children in conflict with the law, particularly after the State of Palestine’s accession to the Convention on the Rights of the Child (CRC) in 2014.
 
In the chapter, Qafisheh argued that the said Decree-Law incorporated the international standards relating to children as enshrined in the CRC and other soft law rules. The question remains: would the legal texts, as manifested by the accession to the Convention and by the aforesaid Law, be materialized at the institutional and practical levels? This question has been discussed by clarifying the legal basis and practical situation relating to children in conflict with law with a view to provide a pathway for potential reform. The paper started by describing the legal basis that governs the juvenile justice and then explored the formal policy at the level of the Palestinian Ministry of Social Development, its personnel and child care institutions. The study finally analyzed the formal juridical cycle: the police, prosecutors, and courts.
 
It is to be mentioned that the “International Handbook of Juvenile Justice” is a comprehensive reference work presents an in-depth analysis of juvenile justice systems across the world.
